What is a mediation video?A mediation video is a short introduction to your client and their story, anywhere between three to ten minutes, depending on your client’s case. The video is an interview-style sampling of your client speaking about their suffering. It may also include the testimony of a close family member, friend, or other witness to your client’s human harm. This video is intended to supplement your mediation brief and be viewed by all parties. It is not meant to share your client’s entire case summary.

Why a mediation video?We know that defense lawyers and their corporate clients often see our worker client as a line item on a spreadsheet and refuse to confront the real human harm caused by corporate misdeeds. The defense focuses their time on nitpicking facts for their summary judgment motion or valuing only lost wages. A mediation video forces the defense to confront your client, see their face and the pain they have caused, and contend with how compelling your client’s story will be in front of a jury or adjudicator. Moreover, your client wants to know that they have had an opportunity to tell the defense their story. Since 99% of cases settle before trial, litigation does not allow a client to experience that empowerment and fulfillment. A mediation video does. It will help your client feel the confidence and satisfaction of knowing that if they choose to resolve the case, that they have told their story.

When should I use a mediation video?Mediation videos are not right for every case. Mediation videos are best used when you believe your client is likeable and compelling, and the other side has not had an opportunity to see them in their best light. Mediation videos are useful when you are mediating a case before you client has been deposed, when the deposition did not explore your client’s emotional damages, or right before trial. A secondary benefit of the mediation video is that it gives your client an opportunity to practice articulating their experience and harm.

How we help attorneys win cases

Select a package
After you’ve made the selection, based on your mediation date we will schedule the dates for (1) on-site filming; (2) draft video; and (3) final production.

Story producer consultation
Our Story Producer does a phone call with you to hear the basics of your client’s story and is available to help you identify a strong narrative vision for your client’s video, if needed.

Select on-site filming
We recommend your client’s home. It is where your client is usually most comfortable and helps them connect with how much the events of the case have upended their lives. Our Story Producer will do a 10-minute virtual meeting with your client while they are at home to pre-stage the interview and explain to them what to expect, including reviewing story prompts.

Shoot day
This will be a two-to-four-hour shoot depending on the A-B-C service, including set up and interviews. Our Story Producers are professional experienced producers who excel at drawing out earnest and compelling testimony.

Draft video
You will have an opportunity to review the draft video and a transcript of all videoed content and make notes before our Story Editor completes the final version.
